Delivery & Returns

1. Packaging
1.1 We will endeavour to ensure that the products are appropriately packaged prior to being sent. The packaging of goods is at our discretion and we reserve the right to pack all the goods in such a way and in such quantities as we consider fit and we are not under any obligation to comply with any packaging specifications or instructions from you.

1.2 We have many years of experience in packaging pottery items for postal and courier delivery. All items are delivered to you in heavy duty cardboard boxes, each item is individually packed with bubble wrap and the boxes are filled with Styrofoam in order to protect your items. In the event of any damaged item please email us a photo and description of the damage within 10 days of receiving your order, to this address: info@porchespottery.com.

2. Delivery
2.1 We will only deliver the products to the cardholders address provided to us by you at the time of ordering. If you would prefer to have your order delivered to another address, such as your workplace or other suitable location, please give us this information when completing your order delivery details. Delivery charges are available in the Delivery options table, and will be made via normal post or professional couriers. Some deliveries will require a signature.

2.2 Delivery dates given by us are an estimate, however we will endeavour to dispatch the goods within 10 working days.

2.3 If we are unable to deliver your order within 20 days of your payment we will notify you of this situation and you will be entitled to a refund if you do not wish to wait any longer for the goods. In certain circumstances we ask that you allow up to 60 days for delivery. We will advise you of any issues regarding your delivery as soon as possible.

3. International Delivery
3.1 If you order goods from our site for delivery outside the EEC, they may be subject to import duties and taxes which are levied when the delivery arrives at the specified destination. The payment of any such import duties or taxes will be your responsibility. Please understand that we have no control over these costs and cannot predict their amount. We advise you to contact your local customs office for further information before placing your order. Please note that you must comply with all applicable rules and regulations of the country for which the products are destined. We are not responsible for any breach by you of any such laws.

3.2 Subject to the other provisions of these conditions, we will not be held responsible to you for any direct, indirect or consequential loss (including without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and similar loss), costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the goods (even if caused by our negligence), nor will any delay entitle you to end or rescind the contract unless such delay exceeds 90 days counting from date of dispatch.

4. Delivery Complications
4.1 If for any reason you do not accept delivery of your order when they are ready for delivery, or we are unable to deliver the products due to your inaccurate instructions, documents, licences or authorisations, the following will occur:

4.2 Risk in the goods will pass to you (including for loss or damage cause by our negligence);

4.3 The goods will be considered to have been delivered; and

4.4 We may store the goods until delivery, whereupon you shall be liable for all ensuing costs and expenses (including, without limitation, storage and insurance).

4.5 We may deliver the goods to in separate packages and installments. Each delivery is a separate contract and no cancellation or termination of any one contract relating to an installment entitles you to cancel any other contract or installment.

4.6 It is your responsibility to check the goods for any damage and that they correspond to what you ordered upon receipt and you must inform us of such damage with 10 days of delivery. If you fail to contact us regarding any such damage, you are deemed to have accepted the goods.

5. Consumer rights
5.1 You are legally entitled to cancel the contract at any time within 7 working days as from the day after you receive the goods. In this event you will receive a full refund of the price paid for the goods in accordance with our returns and refund policy, provided the contract is cancelled within the specified 7 days.

5.2 In order to cancel your contract you must provide us with written notice by email of your cancellation within the 7 days. The goods must then be returned to us in accordance with our returns and refunds policy. You are legally obliged to take reasonable care of the goods whilst they are in your possession. Failure to do so could result in our right of action against you for compensation.

5.3 Your do not have the right to cancel a contract for the supply of any products that are personalised or made for your specification.

6. Liability
6.1 If the goods delivered by us to you are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 10 days of receiving the goods in question.

6.2 If you do not receive the goods you have ordered within 30 days of the date on which you ordered them, you must notify us in writing at our contact address of the situation within 40 days of the date on which you ordered the goods.

6.3 If you notify us about a problem under this condition, our only obligation will be, one of the following:

6.4 To make good any accepted shortage or non-delivery;

6.5 To replace or repair any goods that are damaged or defective, or;

6.6 To refund to you the amount paid by you for the goods in question in whatever way we choose.

7. Returns & Refund policy
7.1 In the event that you return goods to us because you have cancelled the contract as per condition 5, we will process the refund due to you as soon as possible and in any case within 14 days counting from the day you gave notice of cancellation. In such circumstances we will refund the price of the goods in full, including the cost of sending the goods to you.

7.2 In the event that you claim the goods are defective or do not conform to their description, we will examine the returned goods and will notify you of the results of such examination within a reasonable period of time. In the event that the goods are found to have been defective we will offer to repair or replace the goods, or reduce or refund the price of the goods (at your option). We will refund any goods found to be defective within 30 days of this confirmation, the refund will include the cost of the goods, the delivery charges for sending the item to you and the cost incurred to you in returning the item to us.

8. Goodwill Returns / Refunds
8.1 We accept return items within 14 days counting from the receipt of your item for a refund or exchange. You must take reasonable care of the goods while in your possession and they must be returned to us at your cost, unused, in the original packaging and in a re-saleable condition with your original receipt.

8.2 The goods must be returned to us at your own risk, unused, in their original packaging, in good condition. Please contact us via e-mail at info@porchespottery.com to obtain information on how and where to return your items to. Please ensure that you obtain proof of posting certificate from the post office for your returned goods. We regret that we cannot be held responsible for loss of returned goods without proof of posting. Goods returns charges are the responsibility of the sender and we cannot be held liable for any extra returns delivery charges unless the goods are defective.
